What Is the Jones Act?
The Jones Act, officially known as the Merchant Marine Act of 1920, is a federal law that gives injured seamen the right to sue their employers for negligence. Unlike most land-based workers, seamen are not covered by traditional workers’ compensation. Instead, the Jones Act ensures that maritime workers who are hurt on the job can recover compensation when their employer, captain, or crewmates fail to provide a safe working environment.
To qualify under the Jones Act, a worker must:
- Spend a significant amount of their time working on a vessel in navigation, and
- Contribute to the mission or purpose of that vessel.
This means the law typically applies to crew members on ships, barges, tugboats, supply vessels, and other types of commercial vessels operating in navigable waters.
